Corruption Prevention and Combating Bureau (KNAB) has sent to the Prosecutor’s General Office criminal proceedings asking to start criminal prosecution against former member of the Saeima (Parliament of Latvia) for alleged misappropriation of a bribe.
Evidences collected during the investigation show that former official misappropriated a bribe in amount of 5 000 EUR, claiming that it will be given to the public official for a positive decision in clemency of third person.
Bribery intermediary acting on behalf of the convicted person was informed that this bribe will be given to the public official responsible for the review of the clemency request and convicted person will be released.
KNAB investigator initiates to start criminal prosecution against former official for the misappropriation of the bribe, (Criminal Law, Section 321, first paragraph). The giver of the bribe and intermediary were released from the criminal liability because they have voluntary informed of the occurrence and actively cooperated with investigation. (Criminal Law, Section 324 fist and third paragraph).
KNAB states that no person is considered guilty until his guilt of a criminal offence is proved in accordance with the provisions of the Criminal Procedure Law.
